Warranty & Sales Terms
The full terms behind the three-year warranty on our charging hardware, and the sales terms that apply to an order.
Status: DRAFT — pending legal review. Effective date: [EFFECTIVE DATE]
What this document covers
These are the sales terms and the limited warranty for Clink charging hardware sold in Canada, including the NorthernLit 1. They sit alongside our Terms of Use and Privacy Policy.
Definitions
“Product” means the charging unit and the accessories supplied with it. “Purchaser” means the person or business that bought the Product from us or from an authorised reseller. “Commencement date” means the date of purchase shown on the invoice, or the date of registration if the Product is registered with us within 30 days of purchase.
Limited warranty — 3 years
We warrant the Product against defects in materials and workmanship for three years from the commencement date. If a defect appears within that period and the Product was installed and used as required, we will repair or replace the defective part, or replace the Product, at our option. This is the warranty referred to on our product pages; if anything here conflicts with a written warranty shipped with your unit, the shipped document governs.
Registration
Registering your purchase is not a condition of coverage, but it lets us identify your unit quickly and reach you if a safety notice is issued. Registration within 30 days of purchase fixes the commencement date to the registration date.
What the warranty requires
The Product must have been:
- installed by a licensed electrical contractor, in accordance with the electrical code in force where it is installed and with any permit or inspection the authority having jurisdiction requires;
- supplied from a circuit and supply of the type and rating specified for the model;
- used indoors or outdoors as the enclosure rating allows, within the stated operating temperature range;
- used with a vehicle and connector compatible with the model supplied; and
- not opened, modified, or repaired by anyone we have not authorised.
What is not covered
The warranty does not cover:
- damage from installation, wiring, or a supply that does not meet the specification;
- damage from a vehicle, from a supply surge or lightning beyond the Product's rating, or from water ingress beyond its enclosure rating;
- cosmetic wear, cable cuts, vandalism, theft or loss;
- normal maintenance, cleaning and consumable items;
- a Product used for commercial hire or public charging where the model was sold for residential use;
- any unit whose serial number has been removed or altered, or bought from an unauthorised seller.
How to make a claim
Email info@clinkinnovations.com with your invoice, the model and serial number, the installation date and a description of the fault. We may ask for photographs or for a reading from the installation. Do not remove or ship the Product until we tell you to — most electrical equipment must be disconnected by a licensed contractor.
What we will do
If the claim is accepted we will, at our option, supply a replacement part with instructions, arrange a repair, or replace the unit. Replacement parts may be remanufactured or of a later revision performing the same function. We cover the cost of the replacement part and of standard ground shipping within Canada. Labor to remove or reinstall a unit is included only where we have agreed it in writing.
Limits on our liability
To the maximum extent permitted by applicable law, this limited warranty is in place of all other warranties, conditions and representations about the Product, whether implied by statute or otherwise. Our total liability under it is limited to the amount you paid for the Product.
Nothing here excludes or limits a condition, warranty or right that cannot be excluded under the Sale of Goods Act, the Consumer Protection Act, 2002, or any other applicable law. In particular, nothing here limits your rights where a Product is defective in a way that makes it unsafe.
Certification and compliance
Our charging hardware is supplied to UL Listed, the certification applicable to the model as sold in Canada. Installation must still comply with the electrical code and permitting requirements in force at the installation address.
Prices, taxes and payment
Prices are in Canadian dollars, exclude taxes, shipping and installation, and are confirmed in writing. Payment terms are those on the quotation or invoice. Title and risk pass on delivery to the address you nominate.
Delivery and lead times
Lead times are estimates, not guaranteed dates. Where a delay is material and within our control we will tell you and offer a revised date or a refund of any deposit.
Cancellation and returns
Unused Products in original condition may be returned within 30 days of delivery for a refund less shipping and any restocking cost we tell you about in advance. This does not reduce any statutory right of cancellation you have as a consumer under Ontario or other provincial consumer protection legislation.
Support outside warranty
We will still help after the warranty period. Out-of-warranty diagnosis, parts and labor are charged at our then-current rates, and we will quote before carrying out chargeable work.
Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it. Questions about a claim: info@clinkinnovations.com or Clink Innovations Inc., [REGISTERED ADDRESS], Richmond Hill, Ontario, Canada.
